  1. Use of the Site.  By accessing or using this Site, you agree that you will not access or use it for any unlawful purpose or in a manner which could misuse, damage, disable, impair, harm, or interfere with the use and accessibility of the Site.  You may not access any content of the Site from countries and locations where the content or Site use is prohibited.  PFCU reserves the right, at its sole discretion, to revoke access and use authorizations to any Site user at any time for violation of these Terms.  Should you submit or transmit any information or content to this Site, your submission or transmission shall be deemed and remain the property of PFCU.  PFCU reserves the right to hide or delete any posts you submit or display on the Site.
  2. Copyright and Trademark. All information and content on this Site is protected by copyright, intellectual property and trademark laws and is the sole and exclusive property of PFCU and its affiliates.  Reproduction, redistribution, modification or retransmitting any of the information or content of this Site is prohibited without the prior written authorization of PFCU, which may be withheld in the sole discretion of PFCU. Any download of materials shall be for the user’s personal use only.  You acknowledge that by downloading any material, you do not acquire any ownership rights in such material.  Any rights not expressly granted in these Terms are reserved.
  3. Linked Websites. When you visit the Site, you may have the option of clicking on a link that takes you to a third party (non-PFCU) website (“third party website”).  Once you click on a third party website link, you will leave the Site.  Access to any third party website is at your own risk.  The third party website may not be secure.  We recommend that you visit the third party website’s privacy and security policy as well as their terms and conditions, as they will differ from those of our Site.  PFCU does not ensure or guarantee that any third party websites are secure or error-free.  In no event will we be responsible for the content, information or features contained in any third party website.

LIMITATION OF LIABILITY.  UNDER NO CIRCUMSTANCES WILL PFCU, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, SUCCESSORS AND ASSIGNS, BE LIABLE FOR ANY LOSS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF ANY USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF WHETHER PFCU HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING AND REGARDLESS OF THE FORM OF ACTION, WHETHER IT BE IN CONTRACT, WARRANTY, TORT, (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.
  6. Indemnity. You agree to indemnify, defend and hold PFCU, its affiliates, officers, directors, employees, successors and assigns, harmless from any and all claims, demands, losses, penalties, expenses and any and all other damages (including, without limitation, reasonable attorney’s fees) directly or indirectly resulting from or relating to, 1) your use of the Site; 2) your breach of these Terms; 3) your engagement of third party service providers or use of third party links or websites; or 4) your negligence or willful misconduct.    Nothing herein shall limit or reduce PFCU’s responsibilities to its members in accordance with applicable laws and obligations.
  7. Governing Law and Venue.  Your access to this Site and these Terms are governed by and shall be construed in accordance with the laws of the Commonwealth of Pennsylvania and applicable Federal laws.  Any dispute regarding these Terms shall be instituted and adjudicated in the federal and state courts located in Philadelphia County, Pennsylvania.  You consent to jurisdiction and venue in these courts.
  8. Severability.  In the event one or more of these terms of use shall be deemed by a court having jurisdiction as unenforceable, such term shall be severed from these Terms and the remaining Terms herein shall survive in full force and effect.
  9. No Waiver.  No waiver of any of the Terms herein shall be effective unless in writing and signed by an authorized officer of PFCU and no waiver shall be deemed to imply or constitute a continuing wavier of any other term.
  10. Other Agreements. These Terms are in addition to, and do not nullify, any other agreement between you and PFCU or its affiliates.
  11. Access and Force Majeure.  Access to the Site may be unavailable or delayed from time to time.  PFCU shall not be liable for any failure or delay in performance of any obligation it may have with respect to this Site to the extent such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of God, fires, floods, wars, labor disputes, government orders, power interruptions, software failure, hardware failure, system limitations, or for any other cause beyond the control of PFCU. 
  12. Changes to this Policy. PFCU may change this policy from time to time.  Any changes will be posted to the Site and will become effective upon posting, unless otherwise indicated.  It is your responsibility to regularly review these Terms of Use.
