APPLE PAY® AND SAMSUNG PAY® TERMS AND CONDITIONS FOR PFCU MEMBERS
These Terms and Conditions ("Terms") govern your use of eligible PFCU debit cards ("Debit Cards") when you add, attempt to add or keep a payment card in the Digital Wallet ("Wallet") on any iPhone, Samsung, Android, or other mobile device ("Device") that supports the Wallet. The Wallet includes Apple Pay® and Samsung Solutions® services. These Terms also represent your agreement with PFCU regarding the use of your Debit Card with the Apple Pay or Samsung Solutions services. By using your Debit Card in the Wallet, you acknowledge and agree to these Terms, the terms and conditions of your Debit Card and PFCU's current Agreements and Disclosures, which may be amended from time to time. Within these Terms, "you", "your" or "user" refer to the member whose name is located on the Debit Card or any authorized user of the Debit Card. "PFCU", "we", "our" or "us" refers to Philadelphia Federal Credit Union.
Use of your Debit Card. The Wallet enables you to create virtual representations of your Debit Card on your Device and will permit you to use your Device to enter into transactions with merchants that accept the Wallet. You agree to use your Debit Card only with a Device properly equipped with Apple Pay and Samsung Solutions.
ELIGIBILITY
To be eligible to use the Wallet, you must be a member of PFCU in good standing. If you do not maintain membership with us in good standing, we may revoke your Debit Card privileges, including your ability to use the Wallet. Only Debit Cards that we indicate are eligible can be added to the Wallet.
FEES
We do not currently charge any fee for creating or using your Debit Card with the Wallet. However, we do reserve the right to charge a fee in the future. Your wireless company, data service provider, Apple, Samsung or other third party providers may charge fees in connection with your use of the Wallet. You will be solely responsible for all fees that may be imposed by any third parties for your use of any Debit Card in the Wallet, such as data usage or text messaging charges.
PRIVACY
Your privacy and security are important to PFCU and we are committed to protecting your information. We may collect, transmit, store and use certain information about you and your use of the Wallet so that you may use your Debit Card in the Wallet. Any collection, transmission, storage or use of your information is governed by the privacy policy applicable to your Debit Card and PFCU account. Third parties, such as Apple, Samsung and Visa will have access to certain details regarding your Debit Card transactions when using the Wallet. Information you disclose to any third party while using the Wallet is outside of the control of PFCU.
USER REPRESENTATIONS
You represent and warrant that a) your Debit Card belongs to you; b) your account is in good standing with PFCU; c) you shall abide by these Terms, the PFCU Agreement and Disclosures; d) you have the authority to use the Device at issue; e) you will not use the Wallet to commit fraud or any other crime; f) you will comply with all terms and conditions applicable to the Wallet; e) you are age 13 or older.
DISCLAIMERS AND DISCLAIMER OF WARRANTY
PFCU is not the provider of the Apple Pay services, Samsung Pay services or the Wallet. PFCU does not endorse merchants through the Wallet platform. PFCU is not responsible for Cards which are suspended or deleted for whatever reason in your Wallet. PFCU makes no representations, warranties or guarantees of any kind whatsoever related to the Wallet, Apple Pay or Samsung Pay and specifically disclaims any and all warranties of any kind. Without limiting the foregoing, PFCU does not represent, warrant or guarantee the privacy and security of your data connections as they relate to the Wallet, that your Wallet will operate uninterrupted, timely, secure, or error-free and that your Wallet is immune to any unauthorized access. The Wallet and the ability to upload your Debit Card thereto is provided to you "AS-IS" and with all faults and defects that may exist. In no event shall PFCU be liable for any damages to you as a result of your use of the Wallet or your Debit Card being uploaded to the Wallet, including, but not limited to any direct, indirect, incidental, consequential, special, exemplary, punitive damages or lost profits.
INDEMNIFICATION
You agree to protect, indemnify and hold harmless PFCU, its affiliates, employees, officers and directors from and against any and all claims, actions, damages, liabilities, costs and expenses, including reasonable attorney's fees, which arises out of a) your use of the Wallet, Apple Pay or Samsung Pay service; b) your breach of these Terms; and c) your misuse of the Wallet in breach of any applicable law. This paragraph shall survive any termination of these Terms or your participation in the Wallet program.
SUSPENSION OF SERVICES
We may block, suspend, or cancel use of your PFCU issued debit card within the Wallet. We may take these actions at any time and for any reason, such as if we suspect fraud with your debit card, your device becomes lost or stolen, or if applicable laws change.
TERMINATION OF PROGRAM
PFCU reserves the right to make changes to, suspend or terminate its participation in the Wallet program.
SECURITY
You are solely responsible for maintaining the confidentiality of your User ID, passwords and any other means that you may from time to time have to access the Wallet. Call us immediately at 215-934-3500 or 800-832-PFCU (outside the metropolitan area) if you believe your Device or authentication credentials have been lost, stolen or compromised in any way or an unauthorized person has used or may use your credentials without authorization.
ELECTRONIC CONSENT
You agree to receive electronic communications from us, including but not limited to, emails to the email address we have on file in connection with your PFCU account. These electronic communications will relate to your use of the Wallet. To ensure proper delivery of any electronic communication, please make sure your contact information is kept up-to-date.
